There are several criminal offenses that fall under the category of sex crimes in Illinois. One of the most common sex offenses is public indecency. An individual can be convicted of public indecency if he or she is over age 17 and committed one of the following acts in public:

  • Sexual conduct or sexual penetration; or
  • Lewd exposure of the body for the purpose of sexual gratification.

Public indecency is a Class A misdemeanor punishable by up to one year in jail. If a criminal defendant charged with public indecency has previously been convicted of public indecency, he or she faces a Class 4 felony and up to three years' incarceration.

Sexual assault is the term used for non-consensual sex, or rape. Sexual assault occurs when an individual commits an act of sexual penetration and one or more of the following conditions are present:

  • The offender used force or the threat of force;
  • The victim was incapable of consenting to the sex act and the offender knew this;
  • The victim is a family member younger than 18; and
  • The offender is over 17 years old, the victim is aged 13 - 18 years old, and the offender is in a position of authority or trust over the victim.

Sexual assault is generally a Class 1 felony punishable by 4 to 15 years in prison. A sexual assault charge can be increased to an aggravated sexual assault charge for a variety of reasons, including if the offender:

  • Used, threatened to use, or displayed a firearm or other dangerous weapon during the crime;
  • Led the victim to believe he or she was in danger from a dangerous weapon;
  • Caused physical harm to the victim;
  • Behaved in a way that endangered the life of the victim or another individual;
  • Committed the sexual assault during the commission or attempted commission of another felony offense; or
  • Administered a controlled substance, such as an illicit drug, to the victim through threat or deception or otherwise without their consent.

Aggravated sexual assault is a Class X felony, the highest-level felony under Illinois law. It is a non-probational offense punishable by up to 30 years in prison. It is also against the law in Illinois to perform sex acts in exchange for money or to solicit sex acts for money. Prostitution and solicitation of a sexual act are Class A misdemeanors punishable by up to one year in jail and up to $2,500 in fines. However, other prostitution offenses such as promoting prostitution and patronizing a prostitute are felony offenses with much harsher penalties.
