Types of E-Visas
There are three (3) different types of E-visas. Which one is appropriate for you will depend on the nature of your business in the U.S. Each type of E-visa has requirements that must be fulfilled. They include:
- E-1 Treaty Trader visa: The foreign national must be a national of a country that has signed a trade and investment treaty with the U.S., and the foreign national must be coming to the U.S. to conduct substantial trade primarily between the U.S. and the treaty county. Additionally, the foreign national must be employed in a role that is essential to the trading (i.e., executive or manager).
- E-2 Treaty Investor visa: The foreign national must be from a nation that has signed a trade and investment treaty with the U.S., and the foreign national must be coming to the U.S. to oversee the operations of an enterprise in which he/she has invested or is in the process of investing. This visa is only available to the principle investor or an employee that is an executive, manager or who has highly specialized skills.
- E-3 Australian Worker visa: For Australian citizens only, these visas are available to those with a bachelor’s degree or higher employed in specialty positions.
E-visas are initially valid for two years but may be extended indefinitely in some cases. Visas are also available for spouses and unmarried children under 21. At Ana M.
