Lawyers Helping You Clear Your Criminal Record in DuPage County

If you are like many people, you probably assume that you will only have a criminal record if you are actually convicted of a crime. However, anytime a person is arrested, an account of that arrest is entered into his or her permanent record. Even if the individual is not convicted of the crime for which they were arrested, the record of the arrest still exists. Having an arrest on your record can make it much more difficult for you to find suitable housing or employment. Fortunately, there is a way for qualifying Illinois residents to have their criminal records cleared. The dedicated legal professionals at Ana M. Mencini Associates, P.C. have over twenty years of experience helping individuals get their criminal records sealed or expunged.

Rolling Meadows Criminal Defense Attorneys Protecting Your Reputation

Not everyone qualifies for record sealing or expungement. You must meet certain criteria in order to have your criminal record cleared. Your eligibility will depend on a number of factors including the particular offense you wish to have cleared and the rest of your criminal history. Arrests for crimes which you were not convicted of may be eligible for expungement, but convictions cannot be expunged. Expungement completely erases the official record of your arrest. This means that the arrest will no longer affect your ability to pass a background check, gain employment, or qualify for housing or educational opportunities.

If you were convicted of a crime, you cannot have the record of this conviction expunged. However, you may be able to have your criminal record sealed even if your arrest did result in a criminal conviction. A sealed record is only visible on background checks conducted by certain governmental agencies and law enforcement. Most landlords, employers, and other non-governmental personnel will not be able to see your past criminal offenses if your record is sealed. It is important to note that many violent crimes and sex offenses are not eligible for record sealing.
