Nonimmigrant Employment Visas - Temporary Work Visas

Eligible workers are able to come to the United States under a nonimmigrant employment visa. Although in some cases, individuals petitioning for nonimmigrant employment visas are able to eventually request a permanent visa, other workers must show intent to return to their country. Therefore, individuals must prove their work in the United States is actually temporary or non-substantive, such as for a meeting, trade show, or conference.

Nonimmigrant employment visas include:

  • H-1B visa: H-1B visas are available for specialty workers with at least a 4 year college degree (additional availability for individuals with a Masters degree or higher). However, there are a limited number of these visas available each year (approximately 65,000 each year). All applications must be received by immigration by April 1 each year. Many people obtain a temporary work visa and obtain their green card while working in the United States.
  • L visas: L-1 and L-2 visas are available for intra company transferees. If an overseas company has an affiliate in the United States, Certain employees may be eligible for an L visa, such as (L-1) managers or (L-2) employees with specialized knowledge. These individuals may eventually petition for a permanent work visa
  • E visas: E visas are available for treaty investors and traders. This means that if your country has a commercial treaty with the United States and there is a subsidiary of the company within the United States, traders, investors, and employees of the business may be able to request a treaty visa or investor visa.
  • TN (Treaty NAFTA): Under the North American Free Trade Agreement, foreign nationals of Canada or Mexico may obtain a temporary work visa in the United States. TN status visas are often flexible and easy to obtain.
